Terms of Service

These Terms of Service ("Terms") apply when you use the sthan.io website and APIs. By creating an account, using an API key, or using the website, you agree to these Terms. If you are using sthan.io for a company, you agree to them on the company's behalf and confirm you are allowed to do so. You must be at least 18 years old and able to enter into a binding contract to use sthan.io.

If you use sthan.io through a marketplace such as RapidAPI, these Terms apply together with the marketplace's own terms, and your billing is handled by the marketplace.

1. Who We Are

sthan.io is operated by Nishka LLC, a California limited liability company ("we", "us", "our"). "You" means the person or organization using sthan.io.

2. The Services

sthan.io provides APIs and related tools for working with addresses and locations, including US address verification, address parsing, address autocomplete, geocoding and reverse geocoding, India address autocomplete, and IP geolocation (together, the "Services"). We may add, change, or retire features over time. If we retire a paid product you are using, we will give you reasonable notice.

3. Accounts and API Keys

• You must give accurate information when you sign up and keep it up to date.
• Keep your credentials and API keys secret. You are responsible for all use of the Services under your account and keys.
• Tell us promptly at [email protected] if you think a key has been exposed, and rotate it from your dashboard.
• Free plans are limited to one free account per person or organization. Creating several accounts to get more free usage is not allowed.

4. Plans and Billing

• Each product has a free plan and paid plans. Current plans, prices, and monthly volumes are listed on our pricing page.
• Paid plans are billed in advance, monthly or annually, through our payment processor, Stripe. Your plan renews automatically at the end of each billing period until you cancel.
• Prices do not include taxes unless stated. You are responsible for any applicable taxes.
• If we change the price of a plan you are on, we will give you at least 30 days' notice. The new price applies from your next billing period after the notice.
• If a payment fails, we may pause paid features until the payment succeeds.

5. Cancellation and Refunds

• You can cancel at any time from your dashboard. There are no contracts and no cancellation fees.
• Monthly plans: access continues until the end of the current billing period. No refund is issued for the remaining days.
• Annual plans: you receive a prorated refund for the remaining unused months. Access continues through the end of the current billing month.
• Payment processing fees from the original charge are not refundable and are deducted from any refund.

6. Usage Limits

Every plan has a monthly volume and per-minute rate limits. When you reach a limit, the API returns 429 Too Many Requests until the limit resets or you move to a higher plan. We may also slow down or pause traffic that threatens the stability of the Services for other customers.

7. Acceptable Use

You may build the Services into your own products, including products you sell to your customers, and you may resell access to the Services. When you use the Services, you agree not to:

• Use them for anything unlawful, or to process data you do not have the right to process.
• Use the Services to build a copy of our data, for example by querying them in bulk to create your own address or location database or dataset.
• Try to get around rate limits, quotas, or plan restrictions, including by using several accounts or keys to do so.
• Attack, overload, probe for vulnerabilities in, or disrupt the Services or the systems behind them.
• Reverse engineer the Services, except where the law does not allow this restriction.
• Misrepresent your identity or your relationship with sthan.io.

If you resell or embed the Services, you are responsible for your customers' use of them under these Terms.

8. Your Data

You keep ownership of the data you send to the Services. You give us permission to process it only as needed to provide, secure, and support the Services, including keeping records of API requests for the period stated in our Privacy Policy. How we handle personal information is described there. You are responsible for having the right to send us the data you submit.

9. Accuracy of Results

We work to return accurate results, but address and location data changes constantly, and no result can be guaranteed to be correct or complete. Check results before relying on them for decisions with legal, financial, or safety consequences. Do not use the Services as the only source of location information for emergency services.

sthan.io is not CASS-certified and is not a substitute for CASS-certified software when you need it for postal presort discounts on bulk mail.

10. Availability

We aim to keep the Services available and fast, but we do not guarantee uninterrupted or error-free operation. We may perform maintenance, and the Services may occasionally be unavailable. A specific uptime commitment applies only if it is included in a separate written agreement with us.

We are not responsible for delays or failures caused by events outside our reasonable control, such as outages at internet, hosting, or data providers, natural disasters, or actions by governments.

11. Limitation of Liability

The Services are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties not stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim related to the Services is limited to the amount you paid us for the Services in the 12 months before the claim, or US $100 if you have not paid us anything.

12. Indemnity

You agree to defend and compensate us for claims, losses, and costs (including reasonable legal fees) that arise from your breach of these Terms, your misuse of the Services, or the data you submit.

13. Suspension and Termination

You can stop using the Services and close your account at any time. We may suspend or close an account that breaks these Terms, puts the Services or other customers at risk, or has unpaid charges. Where reasonable, we will tell you first and give you a chance to fix the problem. Sections 8, 11, 12, and 15 continue to apply after an account is closed.

14. Changes to These Terms

We may update these Terms. We will post the new version on this page and update the "Last Updated" date. For material changes, we will also notify account holders by email before the change takes effect. Continuing to use the Services after a change means you accept the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute related to these Terms or the Services will be handled in the state or federal courts located in California, and both parties agree to that jurisdiction.

If a court finds any part of these Terms unenforceable, that part will be limited or removed only as much as necessary, and the rest of these Terms will stay in effect. These Terms and our Privacy Policy are the entire agreement between you and us about the Services, unless we sign a separate written agreement. If we do not enforce a right immediately, we have not given it up.
